Roche Bros. MidCo LLC (“Roche Bros.,” “we,” “us,” or “our”) has prepared this Privacy Policy to explain what Personal Data (defined below) we collect, how we use and share that Personal Data, and your choices concerning our practices with respect to your Personal Data. This Privacy Policy applies to the services operated by Roche Bros. and made available to you through our website located at https://www.rochebros.com/ including through our grocery shopping service and Roche Bros. Neighbor Rewards program made available at https://onlineshopping.rochebros.com/ and our catering service at https://catering.rochebros.com (collectively, the “Service”)
This Privacy Policy is incorporated into and forms part of the Terms of Service. Capitalized terms used in this Privacy Policy but not defined shall have the meanings defined in the Terms of Service available at https://www.rochebros.com/terms-and-conditions.

By accessing or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not accept the terms and conditions of this Privacy Policy, you shall not access or use the Services.
1. Information We Collect:
Personal Data You Provide. We collect personally identifiable data or other personal information subject to protection under applicable privacy laws and regulations (collectively, “Personal Data”) that you voluntarily provide such as when signing up for and/or using certain features of our Service. For example, when utilizing our Service, we collect your phone number (which also acts as your membership ID for Neighbor Rewards), your email address for transactional and membership emails, as well as your delivery address when utilizing delivery services for grocery or catering delivery services.
Personal Data We Collect Through Our Social Media Pages: We have pages on social media sites like Instagram, Facebook, Twitter, LinkedIn and TikTok (“Social Media Pages”). When you interact with our Social Media Pages, we will collect Personal Data that you elect to provide to us, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages.
Personal Data We Receive Automatically From Your Use of the Service: When you visit, use and interact with the Services, we may receive and store certain information about your visit, use or interactions. For example, we may monitor the number of people that visit our Service peak hours of visits, which page(s) are visited, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access our Service (e.g., Chrome, Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and navigation pattern. In particular, the following information is created and automatically logged in our systems:
- Log data: Information that your browser automatically sends whenever you visit the Service (“log data”). Log data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with our Service.

- Purchase Behavior Data: We collect information related to your purchases when you use your Customer ID both in-store and online, including the items you browse, add to your cart, or buy, as well as any applicable preferences, transaction history, and purchase frequency. This data helps us tailor product recommendations, promotions, and offers to your interests.
- Location Data: If you allow location access, we collect information about your geographical location via your device. This may include precise real-time location data or general regional information based on your IP address. We use this data to provide location-specific services, such as nearby store recommendations, regionally relevant offers, and personalized shopping experiences.
- Email Open/Click Information: We may use pixels in our email campaigns that allow us to collect your email and IP address as well as the date and time you open an email or click on any links in the email that we may send to you.
2. Cookies
Cookies. We use cookies to operate and administer our website, gather usage data on our website and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. Cookies can be stored on your computer for different periods of time. 3. How We Use Your Personal Data and Other Information:
We want to know about you so that we can better serve you by providing the products and services you wish to have. This includes conducting surveys to get your opinion on how satisfied you are with our Service and to gather your ideas on how we might improve on our services to you. The information will also allow us to notify you about sweepstakes and contests. We may also need information from you and others to help us verify your identity in order to process payments for purchases you make through our Service.

In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with prospective business partners. We may collect aggregated information through the Services, through cookies, and through other means described in this Privacy Policy.
Marketing. We may use your Personal Data to contact you to tell you about products or services we believe may be of interest to you. For instance, if you enroll in Roche Bros Neighbor Rewards and/or elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving emails by following the instructions contained in each promotional email we send you. You can also control the marketing emails and/or push notifications you receive by updating your settings through your account. In addition, if at any time you do not wish to receive future marketing communications, you may contact us at [email protected]. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding management of your account or other administrative matters, such as e-commerce transactional emails, and to respond to your requests.
3. Sharing of Your Personal Data:
We may disclose your Personal Data with third parties under the following limited circumstances:
Service providers. We may share Personal Data with vendors and service providers to assist us in meeting business operations needs and to perform certain services and functions, including providers of hosting services, cloud services and other information technology services providers, event management services, email communication software and email newsletter services, advertising and marketing services, payment processors, customer relationship management and customer support services, and web analytics services. Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us. Brands. We may share Personal Data with brands whose products we sell in order to optimize the products, services and offers that are available to you, including in order to make it possible for these brands to extend offers which may include coupons, special offers, or other information.
Authorities and others. We may disclose your personal information to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. Affiliates. We may share personal information with our current and future affiliates, meaning an entity that controls, is controlled by, or is under common control with us. Our affiliates may use the personal information we share in a manner consistent with this Privacy Policy.

Please note that we are not responsible for the privacy practices or the content of any of these third party websites. We suggest that you check with each website to determine its privacy policy.
5. Security Policy.
We respect your privacy and take measures to ensure that your Personal Data is protected. Any company that we work with to provide services to you that deals with your Personal Data is also required by us to have confidentiality policies in place. We are constantly reviewing information security measures and safeguards so as to ensure that our security measures are in accordance with internet industry standards to protect against unauthorized persons accessing our customers’ Personal Data. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to Roche Bros. via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third party websites.
6. Children.
We do not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not submit any Personal Data to us or otherwise through the Service. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through our Service without their permission. If you have reason to believe that a child under the age of 13 has provided data to us through our Service, please contact us, and we will endeavor to delete that information from our databases.
7. Changes.
Our Service and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. We reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this Privacy Policy periodically, and especially before you provide any Personal Data to and/or through the Services. This Privacy Policy was last updated on the date indicated above. Your continued use of the Service after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
8. International Users.
This Service is intended for use in the Commonwealth of Massachusetts in the United States. If using the Services from outside the United States, you understand and acknowledge that your Personal Data will be transferred from your location to our facilities and servers in the United States.
9. Your Choices.
Opt out of marketing communications: You may opt out of email communications by following the opt-out or unsubscribe instructions at the bottom of the email. You may opt-out from SMS based communications by replying “STOP” or contacting us at set forth below.
Online tracking opt-out: There are a number of ways to opt out of having your online activity and device data collected through our Services, which we have summarized below:
- Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.
